Tribal News: What Is A Plea?
 <br>The word plea is defined by the Black’s Law Dictionary seventh Edition to mean “An accused person’s formal response of “guilty,” “not guilty,” or “no contest” to a criminal charge.” This legal system uses the word plea several different ways; originally you were simply asked, “How do you plea?” You were asked this in an open courtroom before a judge with an attorney beside you and at that point you either answered guilty or not guilty. This was the normal legal system that this country went by and now all of a sudden they have come up with a new system and it is called plea bargaining, which translates as "making a bargain about your plea”. The legal term for it is a 51K or Rule 35 these rules are used when people cooperate with the government it is these same new laws that have been proven to be unconstitutional and is another violation of the 5th amendment from the constitution of the United States. This is strictly a violation ...


of Title 18 USC sections 241 & 242. And even now you have organizations who are trying to educate the public about these injustices, there rights and the law. This is a new system that this country as set up and the fact is it has nothing to do with a plea at all. In actuality it is a legal system of entrapment which is defined by The ‘Lectric Law Library’s Lexicon’ as, “entrapment is when a person is ‘entrapped’ when he is induced or persuade by law enforcement officers or their agents to commit a crime that he had no previous intent to commit;”. As you can see entrapment became outlawed and that means it is illegal to set a person up for them to say that they committed a crime and then charge them with that crime. So the system came up with a whole new program to supposedly eliminate entrapment however they just gave it a new name and now they call it plea bargain. They will get you to pled guilty for crimes they know and that you know you haven’t committed. Now you may ask why they do it. It is because the Federal Government wants to convince the unsuspecting public that they maintain a 95% conviction rate and that these convictions are won legally in a court of law. And this is clearly untrue.

This is how they set up the plea bargain. An individual gets arrested this could be male or female; or as they would prefer; co-conspirators or co-defendants. And then what they do is they divide what they call co-conspirators or co-defendants into separate rooms and they begin to lie and tell each party that the other party has already confessed and they getting less time then you, which could be just one year or probation. They continue on the say, but if you will do a 51k or rule 35 which comes down to mean you become a snitch and you will get less time than the others or probation. They even tell you that you can even take what is looked at as a preferred plea also known as an Alfred plea, which is defined by Black’s Law Dictionary seventh Edition, as “Alfred plea a guilty plea entered into by a defendant in connection with a plea bargain, without actually admitting guilt.” This just means you can basically go home and you never said you did it or that you are guilty. However in the contract, the part the public can see it is never mentioned what kind of plea you took only that you took a plea of guilty. They will simply say you pled guilty to the charges or the indictment and that makes those arrested with you or those that they had already arrested look guilty. Doesn’t this sound liked entrapment? That is exactly what is and it has become legal. The jails are full of young men and women whose friends have turned on them because the prosecuting attorney or the District Attorney has made a deal with them for their own life and this is how they have worked entrapment back into their system. And worse then that, they are actually letting criminals go, like murders as in the case of the assassins who killed Sheriff: Derwin Brown of the Delkab County Sheriff Department. They let rapist go, drug dealers, and bank robbers they will let them go in the street as long as they will get on the stand in the courtroom and testify against somebody else who they don’t even know. This is really happening believe or not in, America today.

Then they convince you to get a court appointed attorney that is also a part of the plot to keep you in prison or if you hire a private attorney, he will hold private meetings with the prosecution where they con him and let him know that there is no way that they are going to let him win this case and that it would be better for his reputation to get your client to plea bargain and this would save face for his legal firm. Some attorney’s like that of the Garland and Loeb firm and Brian Steel firm have a bunch of what we call satellite attorneys that work with them and private investigators that work with them. Like in the Malachi York case they had Mr. Edward Garland of the Garland and Loeb firm put together his own team of satellite lawyers. The high falutin’ lawyers have in their stable, lawyers of different nationalities as in the case of Manny Arora who is an Indian. Or in the case of Janet Singer and Donald F. Samuel who are Jewish or the private investigator Joe Pagani who is an Italian. Garland even mentioned he has a Muslim Attorney called Rashed, And they even have with them a Negroid attorney by the name of Carlton Matthews, who works with them and lastly William Nuckles who is a Southern Euro-American as is Edward Garland usually they all have met while attending the same University like that of the University of Georgia or belong to the same fraternity and this could be on both sides for or against the individual. So as you can see his firm well put together.

Now here is what happens; their lead attorney calms your family initially with a bunch of lies and promises of success. And some have even stooped as low as calling themselves more then an attorney they say he is also a minister. Garland did this to make you think that they have morals and they tell you the case is an easy case and they call it an open and shut case. After they get your hopes up about how easy your case is then they say for you just give a down payment of $50,000 US dollars. And then they say we are going to work till your brother, sister, mother, father, and any family member you may have in prison is outta there. And the $ 50,000 US dollars is a needed retainer’s fee. Then again before they get into the court they call your family who are all in a state of despair, grief and fear and they have a list of preset motions that they use in every case but of course your family would not know this and then they go and tell you I am going to file a motion for this and that. Then they ambush your family and tell them he is going to file a motion for bond so therefore I am going to need another $50,000 US dollars before I go into to courtroom tomorrow. You may now ask is this a movie, and the answer is no this is reality. This is happening everyday in the state of Georgia. The state of Georgia has one of largest conviction and imprisonment rates using this system.

So let me continue. The next day your family appears in court and the high falutin’ lawyer comes and he may stop and visit your imprisoned relative through a cage for a couple of minutes that morning and then proceed tell him I don’t like the way this judge looks. I think he is a racist. What he is doing now is telling you a bunch of the things he thinks you want to hear. He then sighs and takes a deep breath, then he continues to say “we will see what we can do for you just keep hanging in there”. You appear in court and the lawyer sits down while one of his satellite attorneys’ stand up and put forth the many generic motions. The judge then says I won’t rule on these motions now and the prosecution, from the District Attorneys office suggest that you receive no bond so that you can stay in prison, then they send you back to your cell in prison. The lawyers meet your family out side the courthouse and begin with more lies. He tells them that he need another $50,000 US dollars because now he needs to hire an investigator who already works under his law firm and he is going to have to make a lot of telephone calls. So now it becomes necessary for him to make tons of calls, travel to visit the alleged victims, get more research done and hire other assistance that already works under his firm, none of which he does himself. Your relative can’t sit by why you stay in a very uncomfortable, dangerous environment for months. So they will then do all that they can to get you out as would you and that may mean paying any amount to the attorney ask for or even believing the attorney’s words that to take plea, is best for you, that is to say you are guilty to crimes that you never committed would be in your best interest. For this would cause for less money and less fear for the future of a possibility of 100 and more years and possibility a comfortable prison cell. You see the lawyers are just that, agents of the court and they do what they can to assist the court systems to send you to jail without a fuss. They tell you if you take the plea even while knowing you didn’t do it you are going to get benefits for the acceptance of the responsibility. That means you loose points so you get less time, which can put you in a lower level within the prison camp or to a low facility, which is much better and safer then high maximum and medium security prisons; so that also weighs in your mind. At this point you are thinking it is best form me to listen to the lawyer, because he already told me you can’t win and he is getting me the best deal I could ever get. And if I attempt to go to trial and fight I am defiantly going to lose and they are going to give me the most time. It’s all one big plot and more suffering, which is a way to entrap you and it is happening everyday. This has happened to Mr. York and Mrs. Kathy Johnson and others This is a public out cry free Kathy and Malachi!

The notary publics who signed their names and added their seal were Nuwaubians. Shaundra Stubbs (Anosha), and Louise Eddington. Both notary publics, all signed and stamped documents stating "Dwight D. York, aka Malachi Z. York". He had to swear that the information was factual, and they were supposed to check identification.

I knew that was there, and I figured you would find it yourself without me having to point it out. I read that book cover to cover in 1992. I flipped through it from time to time after that. When the UNNM put up a page about his history, yet "denied" the name Dwight D. York as one of his names, I wondered why. Then I saw how they were going to attempt a loophole in the law by saying that the arrest was for some man named Dwight and not for Malachi.
As far as me not having anything to seal--I'll let you keep on thinking that if that is what you need.
