The federal government on May 8, 2002 executed a search warrant and arrest warrant on 404 Shady Dale Rd., a property that he has not owned for over 5 years. The arrest warrant and search warrant was for someone by the name of Dwight D. York. But did they arrest Dwight D. York? In order to prove a person’s identity you must first ask for identification. Before issuing a search warrant the investigators must give probable cause and the person who is to be arrested must be identified to a magistrate judge in order for a search warrant to be issued. The issue at hand is what you call a “Misnomer” according to the Black Laws Dictionary it means a mistake in naming a person, place or thing, especially in a legal document. What this means is that the federal government is not prosecuting the right person and that they never properly identified “Dwight D. York” before, during, or after the arrest. Malachi York was born in Boston, Massachusetts. Where was Dwight D. York born? Malachi York’s was born June 26, 1945. According to the Macon Telegraph Dwight D. York was born in 1968, when they printed his age to be 36. Malachi York’s birth certificate number is 8523 and on this certificate is simply the name “York” with out a first name. What is Dwight D. York’s birth certificate number and is his first and last name listed on it? Who are Dwight D. York’s mother and father? Does Dwight D. York have a driver’s license? Does Dwight D. York have as Social Security Card? Does Dwight D. York have a Bank Account? Has Dwight D. York taken out any loans or mortgages? Does Dwight D. York own a car? Does Dwight D. York own any businesses? Is Dwight D. York a registered to vote? Has Dwight D. York filed income tax returns with the IRS? Has Dwight D. York ever lived in New York as legal resident? Has Dwight D. York ever lived in Georgia as a legal resident? Does Dwight D. York have a passport? Has Dwight D. York ever traveled to other countries? None of these questions can be answered because Dwight D. York is a fictitious person. Malachi York was violently arrested in Milledgeville, GA on a warrant that was addressed for a Putnam County warrant. Malachi York was indicted on charges presented to a grand jury that were against Dwight D. York. Dwight D. York was indicted for a second time in the Federal Case on money structuring counts but Dwight D. York does not even have a bank account in his name, Dwight D. York does not have any income because neither the Federal Prosectuion nor the FBI ever verified employment for Dwight D. York.

So how could Dwight D. York structure money he does not have? The defense Attorney Adrian Patrick called Burton Dukoff, Malachi York’s accountant for over 30 years to the stand and questioned him on Malachi York’s financial history. Mr. Dukoff stated that before he did Malachi York’s accounting his father did it for Malachi York. Mr. Dukoff testified before the court that Mr. York always filed is taxes on time every year and even paid more taxes then required, justifying why he got a tax return every year. Malachi York was so strict with paying his taxes he ever returned to the IRS his income tax returns to be credited to his tax payments for the following year. Mr. Dukoff was then cross examined by Richard Moultrie of the United States Prosecution working for Maxwell Wood:

Dukoff: Anyone can do business under a different name and the accountant may not know it. But I know this man and my father knows this man and we have never known him to go by the name of Dwight D. York and we have been working with him for well over 30 years.

So it is clear even Malachi York’s accountant for over thirty years has never even heard of him referred to by the name Dwight D. York. So where did the prosecution get this name from? How were they able to do a thorough investigation if at the beginning they had the name of the “defendant” wrong? Malachi York’s legal name has never been “Dwight D. York”. The Supreme Court of New York, Sullivan County granted the name change from Isa Al Haadi Al Mahdi to Malachi York on December 27, 1992. Malachi York moved to Georgia in 1993 not someone named “Dwight D. York” nor did someone named “Dwight D. York” live in Sullivan County New York before moving to Georgia. So again Who The Heck is Dwight D. York. Malachi is registered to vote in Clarke County, the census department has come to his home in Athens, GA and he is registered with them as Malachi York, he has a social security card, drivers license, bank account, mortgages, loans and on none of these documents will you find the name “Dwight D. York”. So in this case the Federal Government has violated the law by falsely arresting Malachi York and indicting him under a false identity. While being incarcerated at the Federal Penitentiary in Atlanta, MCC New York, at the Clayton County Sheriff Department, and Putnam County Sheriff Department as “Dwight D. York”. Malachi York could not receive mail unless it came in the name of “Dwight D. York”. Now he can only receive mail and money orders for his commissary in the name of “Malachi York” at the Jones County Sheriff Department.

So when the Federal Government arrested Malachi York by utilizing an over use of force, holding his head against a hot scorching car, with his hands behind his back handcuffed with two guns pointed at his head, they never even did the proper research to know whether they even had the right person. Even though they took his identification and credit cards out of his wallet at the time of the arrest and saw the name Malachi York and saw that not one piece of identification contained the name Dwight D. York why would they continue to arrest the wrong man? It is clear that the prosecution has had problems with this case from the very beginning. Now with the new recantments by Habiba “Abigail” Washington, Jamilla Samaiyah Ellis, along with the original 8 that stated nothing ever happened proving that Malachi York is innocent clearly shows to the public that the Federal Bureau of Investigation and the Putnam County Sheriff Howard Richard Sills has arrested the wrong man.

Who else admitted that Malachi Z. York is Chief of the Yamassee Native Americans of the Creek Nation in Georgia? Well here are responses to Mr. York from the above list of people, make note what each of them refer to him as on these legal documents otherwise if Chief Black Thunderbird is not his name, they are guilty of falsifying documents.

So why are they trying to deceive you? Simply because legally the whole case would be thrown out because of a misnomer. That is they have the wrong name and the wrong person on their written initial warrant. They even have the wrong address, their search warrant was addressed to York and the address was 404 Shady Dale Road. On the initial arrest warrant it had Dwight D. York. However the fact is and Sheriff: Howard Richard Sills knew this, that Dr. Malachi Z. York is not Dwight D. York and never has been, nor does that name in any form appear on his birth certificate. They know that Mr. Malachi Z. York is a resident of Clarke County, that is Athens, Georgia more than sixty five miles away from Putnam County, however the arrest warrant was issued in the wrong name. Dr. Malachi Z. York is a legal resident of Athens-Clarke County , GA. His driver's license, his voter's registration card, the mortgage from his house, his car registration, his dental records, optometrist record, his census record, telephone bills, his cable bill, light bill, water bill, and taxes are all registered in Clarke County and has been since 1999 A.D. when he legally moved from Putnam County and turned the land over to 9 other owners. In the Superior Court of Putnam County, Case 99CV-1-1, February 8, 2002 A.D. Putnam County Attorney Robert T. Prior stated “This morning the County recieved from the Defendant Dwight York a quit claim deed releasing all his interest in the property” See how they use the name Dwight York to force him to respond to it knowing that was not his name. They even used to force him to sign the name Dwight York. This is because they wouldn’t go any further if he didn’t say he was Dwight York although they knew he wasn’t. They are saying he is Dwight York just in order to clean up the mess they made with the false warrants, and they are still trying to clean it up till this very day. So they could have gone straight to the court house in Putnam County and seen they were raiding the wrong people’s property ..And they knew as this case proceeded forward that the whole case would be thrown out if it was discovered that the wrong name was on the warrant. Add in the fact Mr. York wasn't even arrested in Putnam County, he was arrested in Baldwin County, Milledgeville, GA along with his wife Kathy Johnson by Sheriff: William Massee (an associate of Sheriff: Howard Richard Sills), FBI agents, Alcohol Tobacco and Fire Arms (ATF) agents, and agents from the Georgia Bureau of Investigation (GBI) who arrested Dr. Malachi Z. York.

This arrest was not in Eatonton so his arrest was a false arrest of the wrong person according to the name on the warrant the address on the warrant and the real owners of the 404 Shady Dale Road property on record in Putnam County. What is going on here you should be asking. What is this case really about you should be asking yourself. Because remember Dr. Malachi Z. York could be your Pastor, or your father and Kathy Johnson York could be your mother or Pastor's wife. You may not think it could happen to you but nor did they. They thought if they moved out of Putnam County to another County and went on with their lives it would be over. But in fact Sheriff: Howard Richard Sills, Badge 117 acting like a bulldog, neglected all responsibilities as Sheriff-elect and openly admitted on television that he spent his last 6 years stalking Mr. York only after a kangaroo court in which the Judge, C. Ashley Royal picked the jury and there were no physical witnesses, no physical evidence, no DNA,no video tapes, no audio, no medical evidence and he still gave a guilty sentence for 135 years, now reveals by government employees and their lead witnesses that it was all a conspiracy by disgruntled ex-members, one of Malachi Z. York's sons who hates him along with Jalaine Ward, Janna Waddell, Tracy Bowen, Joan Cronier,Noel Lee Wilson, Craig DeLoatch, Judge C. Ashley Royal, Maxwell Wood, Federal Bureau of Investigation (FBI) agents, United States Marshals. There was a conspiracy and it wasn't just against Mr. York it is against Nuwaupians as whole because they saw a progressive fast moving organization and church and this intimidated them because of the Egiptian image thus they set out to destroy what they did not understand. When it was put to the test of who owned what businesses legally it showed how much York wasn't the sole leader of Nuwaupians and that they have their own minds; there were even 9 policemen working on the Macon, Georgia police force that people did not know were Nuwaupians. Why? Because they have their own minds, they are not a bunch of brainwashed zombies. Not to mention all the doctors, teachers , firemen,entertainers, and moviestars who are also Nuwaupians; it’s a world wide organization and church with members in all races . The people behind this conspiracy have fear. That fear turns into corruption. York's armband (while he's in Federal custody in a state institution) has on it York, Malachi ZODOK DOB 6/26/45 Race Sex IM number 10675. That is Malachi Zodok York, as a name, 10675 as a number and under race, unlike Afro Americans who have a “B” for “Black”, his armband has an “I” for “Indian”. They know who he is and what he is yet they lie.

Another part of the lie perpetrated by Sheriff: Howard Richard Sills, Badge 117 and the conspirators was revealed through the trial in order to get the people of Middle District of GA to hate Mr. York and not care about the truth. Another party in the conspiracy is the intial judge after the arrest, Magistrate Judge Claude Hicks, also a news reporter from the Atlanta Journal Constitution namely Bill Osinski and the then-news reporter for the Macon Telegraph Rob Peecher, 139 Lake Forest Drive, Eatonton, Georgia 31024,who currently works for Sills and the Lake Oconee News owned by Eatonton Messenger which is controlled by Sills. Rob Peecher has written most of the derogatory statements against Mr. York the first of which were: he was a convicted felon, which turned out to be untru. He also stated that he was a convicted rapist, which turned out to be untrue and that he had previous gun charges, which alsoturned out to be untrue. They also said Dr. Malachi Z. York was a previous convict in a prison which turned out to be untrue; he was a previous cult leader which also proved to be untrue So none of these slanderous statements by the press and the conspirators turned out to be true, And Mr. Rob Peecher is under suit right now for slander along with with Sheriff Howard Richard Sills Badge 117 and Georgia Smith. So had they given his real, legal name at the beginning, Malachi Z. York, people would have been able to go to their computers and search and find that this man was never charged with any of the above charges. But they give you the wrong name to mislead you intentionally. Let's bring an end to this mess now. This is a Public Outcry. Release Dr. Malachi Z. York and his wife Kathy Johnson York now. They are innocent.

What doesn't York just tell the truth? The Putnam County offical Clerk helped York his group by concurring with Prosecution who were upholding their part of the plea deal to allow Nuwaubians to keep 404 Shadydale, contingent upon York's proposed guilty plea. If York would have accepted additional five years, he would have gotten out in 15years. Nuwaubians would had to have asked the presiding Judge for a June 22, 2004 continuance in York's forfeiture of the 32+ acres that has all the residences, egyptian structures and artifacts on.
This tribal news is all a lie. York fails to explain why earlier appearances of the name Dwight York appears on deeds pertaining to 404 Shadydale property. Nobody forced him in 1993 when original grantor transferred the rights and usage of 404 Shadydale over to York who at the time went by his legal name Dwight York. The Putnam County offical Clerk helped York his group by concurring with Prosecution who were upholding their part of the plea deal to allow Nuwaubians to keep 404 Shadydale, contingent upon York's proposed guilty plea.
