E-mail This Article Printable Version A new trial could be on the way for Nuwaubian leader Malachi York. Monday, York's defense attorney Adrian Patrick told Eyewitness News he plans to file a motion for a new trial by Friday. Patrick feels Judge Ashley Royal made errors in the trial, ones that hurt York's defense.
Last Friday, a federal jury convicted York of ten counts of child sex and racketeering acts, and found him not guilty of one count of transporting minors in interstate commerce for unlawful sexual activity.
Defense attorney Patrick says one thing that hurt his case was the judge's refusal to allow testimony from several witnesses he feels would've supported his argument. Patrick also says the large number of law enforcement officers outside the courthouse tainted the jury. He feels the high security gave jurors the impression York was a dangerous person. The number of law enforcement officers surrounding the courthouse drastically dropped by the end of the trial.
Patrick says if a judge denies his motion for a new trial, he will still appeal the jury's conviction. With the trial over, we are now able to get a closer look at some of the evidence that led to that conviction. FBI agents released a summary of the items they seized during last year's raid on the Putnam County Nuwaubian compound. The summary includes a journal listing 86 of York's biological children with more than 45 women, as well as more than 40 weapons.
York's conviction on Friday is from federal charges. District Attorney Fred Bright says York pleaded guilty to 77 state charges relating to child molestation. He originally faced 197 counts. Attorneys agreed to a 50 year sentence, but Bright says a judge cannot officially sentence York until the federal case is finished.

does he REALLY want a retrial? i mean with this big 'win' it will give courage to MANY MANY other girls and boys this happend to to stand up, i think he will be opening pandoras box, many of the banaats were afraid to get involved to be threatned and persecuted for rightousness and the truth- but they are not afraid anymore, this win for the victims is giving them hope that justice can and will prevail! and many many more will come forth! there are at LEAST 30 more girls who can come forth with same 'allegations' and that is being politely because there were so many of them he had sex with, even some of his old wives in brooklyn were under 17... for his own sake and the sake and embaresment for his nation he needs to just accept his punishment and done- why get more time? and all those people lying for him under perjury laws can get up to half of his sentence! funny how he didtn even take the stand ! why not? isnt he the master teacher he could have shed a new light! but he didnt beacsue he really is a big PUNK when you strip all his self proclaimed tittles!

Well you have to look at it this way. This man KNOWS he's guitly, and will be doing some time! But instead of accepting just 5 more yrs., he decided to figure out a way to leave the nuwaubians WITHOUT a land! He MUST have been angered to know that they said 'saviours day', was the "best one ever" -to quote one of them. Imagine people having fun on "his" land celebrating his birthday, and he's not there! So now, that he did go to trial, and despite the lies that was told on his behalf, justice was done, he was found GUILTY as charged! Now, not only does he remains in jail, his sentence will be increased anyway, and he GAVE the so called "devil" a grip on the land! So, it is ALL about who he can take down with him. If people still continue to lie for him, then they really desreve to be in jail like him. He hopes to waste tax payers money, since he can no longer have access to his. He will take Sills, and all the officials, through the mill, just for the heck of it! He will drag all the young people who were brave enough to get up there, and reveal such embarrasing things that happened to them, just to get back at them in some way He will even give word and hope that some of his still devoted and loyal followers, will try to do something to hurt those who stood up against him, even though they will go to jail like him, and laugh at how he still got them under control As you said, he COULD have taken the stand, if he indeed was innocent, and with his gift of gab, and him being who he "is", don't you think he would have been able to show the judge, jury and his faithfull followers that were there, that "no I did not do these horrible things they said I did" If he was innocent, he WOULD HAVE!

It's funny because the media mentioned Nuwaubians photographing media personnel and prosecuting attorneys. Did it not occur that they too are being photographed! I got clued in on some photos taken of Bunns at Ingles grocery buying liquor. Innocent enough...except it was a whole lotta liquor--hmm, could they be partying after York's conviction? Those of you who like to doubt me--do so--but I've done nothing but show and prove after I've said something

VERY good point Kah.. I hadn't thought of that, but yeah that isn't hard to believe.. I mean what could they possibly prove by taking the pictures?? That these people being photographed do the same things that every other normal, red-blooded american does?? That saying is true.. and I have found it be so on many different planes.. "what's done in the dark will eventually come to light"..

I got clued in on some photos taken of Bunns at Ingles grocery buying liquor. A brother can't buy some liquor, shit you might see me in a photo(except I don't drink).

That was taken out of context i think.. it wasnt the act of buying the liquor.. and supposedly large quantities.. but the time in which they did it.. although (playing devils advocate- no pun intended) people have been known to drink when they are upset.
