What Is Jury Of Your Own Peers?
In simple terms, if a Chinese man who practiced the religion of Buddhism, was accused of a crime and had to go to court for trial, then a jury of his peers would be other Chinese men and women who also practiced the religion of Buddhism. If the 12 people on the jury panel were Euro-American Christians or Jews, or Muslims, then it would not be a jury panel of his peers. They would not have the same Ethnic background or the same religion...
Why is religion so important? Well, in the court system today, witnesses take the witness stand to give sworn testimony. Witnesses are told to swear to tell the truth the whole truth and nothing but the truth so help them God. They do this by raising their right hand and placing their hand on the Christian Bible while giving their oath to tell nothing but the truth. Jurors also take an oath in the same manner. What if the witness or juror is an Atheist who doesn’t believe in the bible or God? What about a Muslim or Jew who have their own holy books, the Koran and the Torah? What about Satanist who’s God is Satan and have their Satanic Bible?
Imagine if the prosecution, the prosecution’s witnesses, and the jurors were of a different ethnic background and religion from the Chinese man. The Chinese man doesn’t have a chance at a fair trial. A good example: Imagine of the lead prosecutor himself announced to the jury that the Chinese man practiced a different religion than everyone else in the courtroom. His constitutional rights would be violated and the case would have to be thrown out. You have a constitutional right (Article III Section 2) to have a fair trial by a jury.
Well guess what? U.S Attorney Max Wood did just that in the case against Malachi York. Mr. York is that Chinese man – why? Well, in open court, Max Wood announced to the jury panel that Mr. York and we quote…”That man”, and he pointed at Mr. York, “He is not a Southern Baptist like us..”. Now Stop. What did this man just do? Max Wood just violated Mr. York’s constitutional rights.
Well guess what? U.S Attorney Max Wood did just that in the case against Malachi York. Mr. York is that Chinese man – why? Well, in open court, Max Wood announced to the jury panel that Mr. York and we quote…”That man”, and he pointed at Mr. York, “He is not a Southern Baptist like us..”. Now Stop. What did this man just do? Max Wood just violated Mr. York’s constitutional rights.
1.Mr. Wood classified himself with the jury as Southern Baptist.
2.Mr. Wood told the jury, that man is other than us
3.Not one of us.
4.Not equal to us
Out the window goes the word peers. If your asking yourself the question, the answer is yes, this is a clear violation of Mr. York’s constitutional rights. As a result, this case should be thrown out. However, the case has been going on for the past 2 years. Despite the statements made by U.S. Attorney Max Wood and the clear violations of Mr. York’s constitutional rights, Mr. York was convicted by a jury other than his own peers and sentenced to 135 years in prison. What are you going to do about it? What is the public going to do about this blatant injustice? This is a public outcry – Free Kathy and Malachi!
